Welcome to **Appleton Imagery**. By accessing or using our services, you agree to comply with and be bound by the following terms and conditions. Please read these terms carefully before using our website or booking any services.

**1. Services** 

Appleton Imagery provides professional photography services, including but not limited to wedding and engagement photography. By booking our services, you agree to the terms outlined in this agreement.

**2. Booking and Deposits** 

- A non-refundable deposit is required to secure your booking date. The deposit will be applied toward the total cost of your selected package.

- Final payment is due prior to the event or session, as specified in your contract.

- If the deposit is not received, we reserve the right to release the reserved date to other clients.

**3. Cancellations and Refunds** 

- All deposits are non-refundable. This ensures the date and time reserved for your session are secure, preventing other bookings.

- Cancellations of the scheduled session or event will result in forfeiture of any payments made.

- In the event of unforeseen circumstances or emergencies, please contact us to discuss rescheduling options.

**4. Image Delivery and Usage** 

- Appleton Imagery retains the rights to all images for use in promotional materials, social media, website portfolios, and other business-related purposes. If you do not wish to have your images shared publicly, please inform us in writing.

- Clients are granted personal use rights for their delivered images, allowing them to print, share, and distribute the images for non-commercial purposes.

**5. Client Responsibilities** 

- The client is responsible for communicating specific requests, details, and expectations in advance of the event or session.

- It is the client’s responsibility to secure necessary permissions for photography at the chosen venue(s). Appleton Imagery is not responsible for restrictions imposed by venues.

- The client is expected to arrive on time for sessions. Any delays may affect the time available for photography and may result in fewer images delivered.

**6. Rescheduling** 

- In case of inclement weather or unforeseen circumstances, rescheduling may be arranged at no additional cost. However, any rescheduling must be agreed upon by both parties and is subject to availability.

- If rescheduling is required by the client for reasons other than emergencies, a new deposit may be required to secure the new date.

**7. Limitation of Liability** 

Appleton Imagery strives to deliver high-quality images; however, we cannot be held liable for circumstances beyond our control, including but not limited to:

- Equipment failure

- Weather conditions

- Venue restrictions

- Client or guest interference

In the unlikely event that the final images are lost, damaged, or unusable, our liability is limited to a refund of all payments received.

**8. Copyright** 

All images taken by Appleton Imagery are the copyrighted property of Appleton Imagery. Clients are prohibited from editing, altering, or selling the images without express permission.

**9. Force Majeure** 

Appleton Imagery will not be liable for any failure or delay in performance due to circumstances beyond our control, including but not limited to natural disasters, pandemics, accidents, or governmental restrictions.

**10. Governing Law** 

These terms are governed by and construed in accordance with the laws of BC, Canada. Any disputes arising from this agreement will be resolved in accordance with the laws of this jurisdiction.

**11. Changes to the Terms** 

Appleton Imagery reserves the right to update or modify these Terms of Service at any time without prior notice. Any changes will be posted on this page, and your continued use of our services signifies your acceptance of the revised terms.
